Terms and Conditions

1. Definitions
“Reviewise”, “we”, “our”, “us” refers to the business operating under the ABN of Soairse Blaney.
“Client” refers to any business engaging Reviewise for services.
“Services” refers to automated review request systems, SMS workflows, CRM integrations, reporting and related marketing automation services.
“Customer Data” refers to any information provided by the Client relating to their customers.
2. Acceptance of Terms
By engaging our Services, the Client agrees to be bound by these Terms and Conditions.
If the Client does not agree, they must not use our Services.
3. Scope of Services
Reviewise provides:
Automated SMS review request workflows
Follow-up messaging sequences
CRM integrations (where supported)
Monthly reporting
Initial system setup
Optional bulk review campaigns
We do not guarantee:
A specific number of reviews
Specific rankings on Google
Revenue increases
We provide automation tools designed to improve review consistency.
4. Client Responsibilities
The Client agrees that they:
Have lawful authority to provide customer contact information
Have obtained any required consent to send SMS communications
Will comply with Australian Spam Act 2003 and telecommunications regulations
Will ensure customer data is accurate
Will notify us of any compliance concerns
The Client is solely responsible for the legality of customer contact data supplied.
5. SMS Communications
Reviewise sends SMS messages on behalf of Clients using automated systems.
We act as a technology provider and processor only.
The Client is responsible for:
Ensuring consent exists
Managing opt-out requests (unless managed through our system)
Ensuring compliance with local laws
We are not liable for regulatory penalties resulting from Client non-compliance.
6. Fees & Payment
Services are provided on a subscription basis unless otherwise agreed.
Payment terms:
Monthly recurring fee as agreed
Payment is due in advance
Payment processed via Stripe or approved payment provider
Failure to pay may result in suspension or termination of Services.
All fees are exclusive of GST unless stated otherwise.
7. No Guarantee of Results
Reviewise provides marketing automation systems.
We do not guarantee:
Specific review quantities
Google ranking improvements
Lead volume increases
Customer response rates
Review outcomes depend on factors outside our control, including:
Client service quality
Customer behaviour
Market conditions
Google platform changes
8. Bulk Review Campaigns
Bulk campaigns involve sending review requests to historical customer lists supplied by the Client.
The Client confirms:
They have lawful consent
The data is accurate
Messages are compliant
Reviewise is not responsible for complaints or regulatory issues arising from improperly sourced lists.
9. Data Protection
We take reasonable steps to protect Client and Customer Data.
However, the Client acknowledges:
No online system is 100% secure
Third-party platforms (GoHighLevel, SMS providers, Stripe) are used
Data may be stored outside Australia
10. Intellectual Property
All workflows, systems, templates and automation structures remain the intellectual property of Reviewise.
Clients receive a licence to use the system during the subscription term only.
11. Limitation of Liability
To the maximum extent permitted by law:
Reviewise is not liable for:
Indirect or consequential losses
Loss of revenue
Loss of profits
Regulatory fines caused by Client misuse
Google platform changes
Third-party outages
Our total liability is limited to the fees paid by the Client in the preceding 3 months.
12. Termination
Either party may terminate with 14 days written notice.
Upon termination:
Automation access will cease
Data may be deleted after 30 days
Outstanding fees remain payable
No refunds for partial billing periods unless required by law.
13. Service Availability
We aim to maintain continuous service.
However, we are not liable for interruptions caused by:
Hosting providers
SMS carriers
Google
CRM platforms
Force majeure events
14. Modifications
We may update these Terms at any time.
Continued use of Services constitutes acceptance of updated Terms.
15. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Any disputes shall be subject to the jurisdiction of NSW courts.
